# MJ Deco Studios – Terms of Service for Media Delivery

Welcome to MJ Deco Studios! By booking services and receiving digital media galleries from MJ Deco Studios, you agree to the following Terms of Service. These terms ensure a clear understanding of how media is delivered, how it can be used, and what is included with your purchase.

#1. Media Delivery Timeline
After the completion of your photoshoot or media creation session, your final media gallery will be delivered via a secure, password-protected online platform. The typical delivery timeline is within [Real Estate: 24-72 hrs / Marketing, Headshots, Architectural: 96hrs-2 weeks] from the date of the shoot. Delivery times may vary based on the complexity of the project and any additional services requested.
Expedited delivery may be available for an additional fee. Please inquire for details.

## 2. Media Format & Access
- Your media will be delivered in digital format through an online gallery link.
- The gallery will be accessible for a period of 1 year from the delivery date unless otherwise agreed upon. After this period, access to the gallery may expire unless extended by request.
- Media will be provided in a high-resolution format suitable for print and web optimized format suitable for digital marketing, and listing platforms.
Clients are responsible for downloading and securely storing their media files once delivered. MJ Deco Studios is not responsible for providing backup files after the access period expires.

## 3. Usage Rights & Licensing
Upon full payment, you are granted a non-exclusive, limited-use license to use the media for marketing and promotional purposes related to the property or business featured in the photos/videos.
This includes, but is not limited to:
- Property listings on MLS and real estate websites
- Social media marketing
- Print and digital advertisements
Restrictions:
- You may not sell, transfer, or redistribute the media to third parties (e.g., other photographers, agencies, other businesses, or clients) without prior written consent.
- You may not edit, alter, or manipulate the media in any way beyond basic cropping or resizing without express permission from MJ Deco Studios.

## 4. Pro Package Edits & Additional Photoshop Requests
The Pro Package includes premium edits such as:
- Window exposure adjustments to showcase outdoor views
- Digital screens on televisions
- Digitally filled fireplaces
Additional Photoshop edits (e.g., removing objects, extensive retouching, or adding virtual décor) may or may not be covered under the Pro Package. Please inquire about specific requests before your shoot to confirm what is included. Any additional editing requests after delivery may incur additional fees.

## 5. Cancellation, Rescheduling, and Weather Policy
- Cancellations must be made at least 24 hours in advance to avoid a cancellation fee.
- Rescheduling is allowed without penalty if requested at least 24 hours in advance.
- In the event of poor weather conditions, MJ Deco Studios will proceed with the scheduled shoot unless otherwise requested by the client. Post-production edits such as blue sky replacements can be added if weather conditions are unfavorable during the shoot.

## 6. Payment Terms
Full payment is required before or upon delivery of the final media gallery unless otherwise agreed upon in writing.
Accepted payment methods include:
- Credit/Debit Cards
- Online Payment Platforms (e.g., PayPal, Venmo)
- Checks (by prior arrangement only)
- Cash
Late Payments:
Late payments may result in delayed access to your gallery. Unpaid balances beyond 30 days may incur a late fee and may be subject to collections.

## 7. Media Alterations & Client Responsibilities
Clients may request minor adjustments to the delivered media within 48 hours of gallery delivery. Requests made after this timeframe may be subject to additional fees.
Examples of acceptable requests:
- Minor color corrections
- Cropping or resizing for specific platforms
- Adjustments to window exposures or virtual staging elements
Extensive alterations, including virtual staging redesigns or additional edits, are not included in the initial fee unless otherwise specified.

## 8. Client Usage Disclaimer
While every effort is made to provide high-quality media, MJ Deco Studios is not responsible for how the media is displayed or perceived once uploaded to third-party platforms. Clients are responsible for ensuring that media files meet the specifications required by their chosen listing platforms, websites, or marketing materials.

## 9. Refunds & Revisions Policy
All services provided are non-refundable once the media gallery has been delivered. Revisions are available within 48 hours of delivery for minor adjustments. Beyond this period, any additional edits or revisions will incur an extra fee.

## 10. Limitation of Liability
MJ Deco Studios is not liable for any damages resulting from the use or inability to use the delivered media, including but not limited to technical issues on third-party platforms, file compatibility errors, or unintended alterations made by third parties after delivery.

## 11. Privacy & Confidentiality
MJ Deco Studios respects your privacy and ensures that all media galleries are delivered through a secure, password-protected system. Your media will not be shared with any third party without your consent.

## 12. Agreement to Terms
By booking a service with MJ Deco Studios and accepting the delivery of your media gallery, you agree to these Terms of Service. These terms may be updated periodically, and clients will be notified of any significant changes.
